These Terms of Service ("Terms") govern your access to and use of the Aircad web application and related services (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement and that you have the authority to agree to these Terms on behalf of yourself (or any organization you represent).
Accounts
You sign in with Google or with a code sent to your email. Access during private alpha is by invitation; requesting access does not guarantee it. You are responsible for the security of the Google or email account you sign in with and for activity under your Aircad account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
Your content
You retain all rights to the CAD drawings, geometry, text, images, and other content you create or upload ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, store, transmit, display, and process Your Content solely as needed to provide the Service to you and to people you share with — including members of teams you add Your Content to.
You represent that you have the rights to Your Content and that it does not infringe the rights of any third party, violate any law, or contain malicious code. People you share with can view, copy, and export that content; you are responsible for whom you invite.
The Service
We retain all rights in the Service itself, including the software, design, and trademarks. Using the Service does not grant you a license to copy or redistribute it. Third-party software notices are listed at /licenses.txt.
Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Upload content that is unlawful, infringing, defamatory, or harmful.
- Attempt to probe, scan, or disrupt the Service or its infrastructure, except as permitted by applicable law.
- Use automated means to access the Service in a manner that degrades performance for other users or circumvents rate limits.
- Resell, sublicense, or otherwise make the Service available to third parties as a service without our written permission.
Service availability and changes
The Service is provided on an "as is" and "as available" basis during private alpha. Features may change, break, or disappear without notice. We may add, modify, or remove features at any time, and we may suspend or discontinue the Service (in whole or in part) for any reason. Do not treat the alpha as a system of record; keep your own copies of work you cannot afford to lose.
Fees
The Service is currently free to use. If we introduce paid plans, pricing terms will be presented in-app and continued use of paid features will be subject to those terms.
Termination
You may stop using the Service at any time. If you have alpha access, you can delete your account from the Account page. We may suspend or terminate access if you violate these Terms or if we reasonably believe continued access poses a risk to the Service or other users. Upon termination, files you own may be deleted; export anything you want to keep first. What deletion does and does not remove is described in the Privacy Policy.
Disclaimers
The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Aircad is not intended for safety-critical use; do not rely on it as the sole source of truth for engineering, medical, legal, or other decisions that may meaningfully impact people or property.
Limitation of liability
To the maximum extent permitted by law, Aircad and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangibles arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months preceding the claim, which during private alpha will typically be zero.
Indemnification
You agree to defend, indemnify, and hold harmless Aircad from and against any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be resolved exclusively in the state or federal courts located in Delaware.
Changes to these Terms
We may update these Terms from time to time. Material changes will be noted by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
